This manual is published in terms of section 51 of the Promotion of Access to Information Act, 2 of 2000, as amended by the Protection of Personal Information Act, 4 of 2013. It describes the records held by ElcoLynx (Pty) Ltd and how access to them may be requested. Download as PDF.
The Information Regulator has compiled a guide, in terms of section 10, for a person wishing to exercise a right under the Act. It is available from the Regulator at JD House, 27 Stiemens Street, Braamfontein, Johannesburg, on 010 023 5200, at inforeg@justice.gov.za, or at inforegulator.org.za.
ElcoLynx has not published a notice in terms of section 52(2). No categories of records are automatically available without a formal request at this time.
Records are kept in accordance with, among others, the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Tax Administration Act 28 of 2011, the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Unemployment Insurance Act 63 of 2001, the Compensation for Occupational Injuries and Diseases Act 130 of 1993, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013.
Personal information is processed to provide and support software, domain, email, hosting and related managed services; to quote, invoice and collect payment; to provide technical support; to communicate with clients and suppliers; and to comply with legal obligations.
Domain registries and registrars including ZACR; cloud and infrastructure providers; software and licensing vendors; accounting and payment providers; and professional advisers or regulators where legally required.
Personal information may be processed on infrastructure outside the Republic, including that of Cloudflare, Google, Microsoft, Xero and transactional email providers. Such transfers are made in terms of section 72 of POPIA, on the basis that the recipient is subject to a law, binding corporate rules or a binding agreement providing an adequate level of protection, or with consent, or because the transfer is necessary to perform a contract.
A request must be made on the prescribed form and delivered to the Information Officer at the address above. It must identify the record and the requester, state the form of access required, and identify the right the requester seeks to exercise or protect and why the record is required.
We respond within 30 days, extendable in the circumstances contemplated in section 57. A request may be refused on the grounds in Chapter 4 of Part 3 of the Act, which include the mandatory protection of a third party's privacy, a third party's commercial information, and legally privileged records. A request fee and access fee may be payable as prescribed.
This manual is available on this website, at our registered address during business hours, to the Information Regulator on request, and to any person on request against payment of the prescribed fee. It is reviewed at least annually and whenever the particulars in it change.
